Terms & Conditions – The Wos Hotels
Effective date: January 2, 2026
- Scope
These Terms & Conditions apply to all contracts for the rental of apartments for accommodation purposes and all related services provided by The Wos Hotels (hereinafter “Provider”), regardless of whether the booking is made directly or via third-party platforms.
- Conclusion of Contract
An accommodation contract is only concluded upon receipt of a booking confirmation from the Provider and the successful authorization or charge of the payment method provided by the guest.The Provider is entitled to verify or pre-authorize the payment method at any time prior to arrival.If authorization fails or no valid payment method is provided, the Provider is entitled to release the reservation without further notice.
- Prices and Payment
All prices are total prices and are subject to a dynamic pricing system depending on demand, booking time and availability.The Provider reserves the right to cancel or contest bookings in the event of obvious pricing, availability or system errors.Payments are processed exclusively via the available online payment methods.
- Withdrawal by Provider / Overbooking / System Errors
The Provider is entitled to withdraw from the contract if:
- payment authorization fails
- technical disruptions or system errors occur
- overbooking or double booking arises
- the provision of services becomes impossible for reasons beyond the Provider’s control
- cases of force majeure or safety-related circumstances occur
In such cases, payments already made will be fully refunded.Further claims by the guest, in particular claims for damages, are excluded unless they are based on intentional or grossly negligent conduct by the Provider.
- Check-in and No-Show
Access to the apartments is generally contactless and available at any time.If the guest fails to arrive on the agreed check-in date without prior notice (no-show), the entitlement to the booked service expires. Refunds are excluded unless mandatory legal provisions apply.
- Use and Occupancy
The apartments may be used exclusively for accommodation purposes.Maximum occupancy:
- 2 persons per apartment
- 4 persons in penthouse units
Exceeding the permitted occupancy is only allowed with prior approval.In case of violation, the Provider is entitled to terminate the contract without notice. Refunds are excluded to the extent legally permissible.
- Identification Requirement
The guest is obliged to provide complete and accurate identity information prior to arrival.The Provider is entitled to deny access if such information is missing or obviously incorrect.
- Access System and Technical Availability
Access is provided via a digital access system.Access credentials may be shared with co-travelers at the guest’s own responsibility. The booking guest is liable for all damages arising from such sharing.The Provider does not guarantee uninterrupted availability of technical systems but will make reasonable efforts to resolve disruptions as quickly as possible.Continuous 24/7 support is not guaranteed.
- House Rules and Conduct
The guest is obliged to comply with the house rules.In particular, noise disturbances, unauthorized use and over-occupancy are prohibited.In the event of violations, the Provider is entitled to terminate the contract without notice.
- Commercial Use
Commercial use of the apartments, in particular for events, filming or photography, is prohibited without prior consent of the Provider.
- Early Departure
In the event of early departure, no refund will be granted. Refunds may be issued solely at the Provider’s discretion.
- Parking
Parking spaces are available in limited numbers and must be reserved in advance. There is no entitlement to a parking space.
- Additional Services
Additional services are provided voluntarily. There is no entitlement to their availability or functionality.
- Damages and Cleaning
The guest is liable for all damages caused by them as well as for extraordinary cleaning requirements.These costs will be charged to the guest accordingly.
- Access Media
In case of loss of access media (e.g. chips), a flat fee of €40 per item will be charged.
- Internet Usage
There is no entitlement to continuous internet availability.
- Liability
The Provider’s liability is limited, to the extent permitted by law, to typical and foreseeable damages.Liability for damages resulting from injury to life, body or health, as well as liability for intent and gross negligence, remains unaffected.
- Disturbances by Third Parties
The Provider shall not be liable for disturbances caused by other guests or third parties, unless such disturbances are due to intentional or grossly negligent conduct of the Provider.
- Reallocation
The Provider is entitled to relocate the guest within the property to an equivalent or higher category unit.
- Minimum Age
Bookings may only be made by persons of legal age.
- Video Surveillance
Video surveillance is conducted exclusively in publicly accessible areas in compliance with applicable data protection laws.
- Maintenance and Limitations
Short-term limitations, in particular due to maintenance work or technical disruptions, do not entitle the guest to price reductions, provided they are reasonable.
- Final Provisions
German law shall apply.Should any provision be invalid, the validity of the remaining provisions shall remain unaffected.
